The Commission’s Legal Affairs team provides advice and support across a broad range of operational, policy, and governance matters. In addition to supporting litigation and judicial review proceedings, the legal department assists with legislative interpretation, policy development, procedural fairness considerations, risk management, and organizational decision-making.

Through legal analysis and advice, Legal Affairs supports the Commission and the Chief Commissioner in the fair, independent, and impartial administration of The Saskatchewan’s Human Rights Code, 2018, and helps ensure that statutory responsibilities are exercised consistently with the legislation, principles of procedural fairness, and evolving legal obligations.

JUDICAL REVIEW AND ACCOUNTABILITY

Judicial review is an important part of Saskatchewan’s human rights system. Court decisions provide guidance regarding legal interpretation, procedural fairness, and statutory authority. This feedback assists the Commission in continuously improving its processes and ensuring that decisions remain consistent with legislative and judicial expectations.

During 2025-26, the Commission received judicial guidance regarding aspects of its complaint intake and assessment processes. The Court’s decision provided clarification regarding the legal framework applicable to certain early-stage complaint assessments and reinforced the importance of ensuring that statutory authority is exercised in accordance with the requirements of procedural fairness, administrative law, and The Saskatchewan Human Rights Code, 2018.

The Commission carefully reviewed the decision and considered its implications for existing practices, procedures, and internal guidance. As part of its commitment to continuous improvement, the Commission continues to evaluate opportunities to strengthen the consistency, transparency, and fairness of its complaint resolution processes. This includes reviewing operational practices, refining decision-support tools, enhancing staff training, and ensuring parties receive clear information about Commission procedures and decisions.

The Commission views judicial guidance as an important mechanism for maintaining public confidence, strengthening decision-making, and ensuring the human rights system remains fair, effective, and responsive to evolving legal standards.
